Is my personal information secure?

Yes.

Certain features or services offered on or through the Site may require you to open an account (including setting up an Holiday Nova® ID and password). You are entirely responsible for maintaining the confidentiality of your account information, including your password.

We keep your name, email address, phone number and booking details for tax purposes, emergency contact or contact under specific membership agreements.

We may share your information:

Wtih Suppliers, such as but not limited to hotels, airlines, cruises, or car rental companies, or activity providers, or travel agents who fulfill your travel reservations. We do not share your email address with these suppliers unless they need it to fulfill the travel reservation you have made on holidaynova.com, and we restrict their use of this information to that purpose. Please note that these suppliers also may contact you as necessary to obtain additional information about you or to facilitate your travel reservation.

Third-party vendors who provide services or functions on our behalf, including credit card processing, business analytics, customer service, marketing, distribution of surveys or sweepstakes programs, and fraud prevention.

To subpoenas, court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us.

When we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of holidaynova.com, our customers, or others; and in connection with our Terms of Service and other agreements.

CUSTOMER USER CONTRACT

PARTIES

"Holiday Nova" And "Customer"

BACKGROUND

  1. Holiday Nova provides accommodation, holiday activities, tours, travel, vehicle rental and associated services and products throughout the world.

  2. Holiday Nova operates a website accessible through www.holidaynova.com ("Site") and which sets out the services and products made available by Holiday Nova or by the providers and owners of the services and products ("Services and Products").

  3. Access into or use of the site is authorized by Holiday Nova only in accordance with this User Agreement and with the Site terms and conditions.

  4. The Customer wishes to access and use the site in order to purchase Services and Products in accordance with this agreement.

AGREEMENT

Payment for products and services

  1. In consideration of the Customer paying for any product or service accessed and selected by the Customer from the Site in accordance with this Agreement, Holiday Nova allows the Customer access to the Site in accordance with the Site terms and conditions and privacy policy.

  2. The Customer shall pay Holiday Nova or any other person directed by Holiday Nova the full amount of any Service or Product accessed and selected by the Customer from the site including any applicable Government taxes and charges.

  3. The payment made by the Customer under clause 2 will be made up front in accordance with the requirements of Holiday Nova and of any service or product provider and must be completely paid for prior to the service or product being undertaken or used by the Customer.

Term of agreement

  1. This Agreement commences on accordance to the date in your confirmation email and continues unless and until terminated in accordance with clause 17-19.

Replacement of Product or Service and Refund of Price

  1. Either Holiday Nova or the service or product provider has the right, in their absolute discretion and without notice to the Customer, to cancel any service or product originally purchased by the Customer from the Site at any time including during the performance of such service or product for any reason or for no reason.

  2. If the service or product is cancelled in accordance with clause 5, the provider of the service or product shall, at its discretion, either replace the cancelled service or product with a service or product of equivalent or greater value, standard, duration or type or, alternatively, will refund the full purchase price including any Government taxes paid by the Customer for the original cancelled service or product within thirty (30) days of such cancellation occurring less any administration/handling fee.

  3. The Customer shall only be entitled to receive a refund of the original purchase price of the cancelled service or product including any Government taxes without payment of any interest and acknowledges that neither Holiday Nova nor the provider of the cancelled service or product shall be liable or obliged to pay any compensation, damages, general damages, special damages, aggravated damages or exemplary damages of any nature or kind allegedly caused directly or indirectly from the cancellation.

Cancellation by Customer

  1. The Customer agrees to access and read the cancellation policy of Holiday Nova set out in the Site terms and conditions or attached to the service or product of the owner.

  2. In the case of any conflict, discrepancy or ambiguity between the cancellation policy of Holiday Nova set out in the Site terms and conditions on the one hand and the cancellation policy of any owner of any service or product purchased by the Customer on the other hand, the Customer agrees to be bound by the cancellation policy of the owner of the particular service or product.

  3. The Customer may cancel any service or product purchased from the site under this agreement subject to the following conditions:

    1. The Customer will not be automatically entitled to a refund of the purchase price of the cancelled service or product.

    2. Either Holiday Nova or the product owner may, in their absolute discretion, decide to offer the Customer a similar type of Service or Product of the same or higher value at any time within twelve (12) months of the date of cancellation by the Customer.

    3. If in their absolute discretion Holiday Nova or the owner of the cancelled service or product does decide to refund the whole or any part of the purchase money, such refund shall:

      1. not include any interest or damages, general damages, special damages, aggravated damages or exemplary damages;

      2. deduct an administration/handling fee representing 15% of the purchase price; and

      3. be in accordance with the following table:

        i)

        Cancellation less than seven (7) days prior to date of performance or occurrence of service or product

        No refund

        ii)

        Cancellation more than seven (7) days but less than thirty (30) days prior to date of performance or occurrence of service or product

        50% refund

        iii)

        Cancellation more than thirty (30) days but less than ninety (90) days prior to date of performance or occurrence of service or product

        75% refund

        iv)

        Cancellation more than ninety (90) days but less than one hundred and eighty (180) days prior to date of performance or occurrence of service or product

        100% refund

        v)

        In each of the refunds set out above in i) - iv), the amount of the refund shall deduct the 15% administration/handling fee referred to in subclause 10(c)(ii) above

         

Compliance with Terms and Conditions

  1. The Customer acknowledges his or her obligation under this agreement to access and read the following:

    • Site terms and conditions;
    • Site privacy policy;
    • Terms and conditions of specific services and products offered on the Site by Holiday Nova or any provider; and
    • Cancellation policy of any service or product offered on the site by Holiday Nova or by any provider

Service and Product Review

  1. In consideration of Holiday Nova allowing the Customer to access the Site in accordance with this Agreement and the Site terms and conditions, the Customer agrees to complete a service or product review which will be sent to the Customer after the service or product has ended.

  2. The Customer will complete and return the survey review to Holiday Nova within seven (7) days of the Customer receiving the survey review.

  3. The Customer also agrees to return the survey review to Holiday Nova including comments on the service or product, ratings of the service or product, uploaded photographs and U-tube videos.

  4. Upon receipt of the survey review, all intellectual and proprietary interests in the comments, responses, photographs and videos shall immediately transfer from the Customer to Holiday Nova.

  5. Holiday Nova shall at its discretion incorporate all or any part or none of the completed survey review including any comments, ratings, photographs or videos onto the Site for such period as Holiday Nova may decide in its absolute discretion and may further remove such material from the Site at any time in its absolute discretion.

Termination

  1. Holiday Nova may revoke and cancel a Customer's right to access, enter or use the Site at any time and for any or for no reason either with or without notice to the Customer.

  2. Holiday Nova may terminate this Agreement immediately without notice to the Customer if the Customer commits any breach of the Site terms and conditions, of the Site privacy policy or of any term or condition of this Agreement which in the sole and unfettered discretion of Holiday Nova not capable of remedy.

  3. Holiday Nova may terminate this Agreement from the expiry of any time specified in any notice given to the Customer to rectify any breach which is capable of remedy in the sole and unfettered discretion of Holiday Nova and such breach remains un-rectified beyond the period of notice.

  4. Either party may terminate this Agreement if the other party is placed into receivership, liquidation or under administration in accordance with Australian law.

Entire Agreement

  1. This Agreement, together with the Site terms and conditions and Site privacy policy constitute the entire contract for the performance of rights and obligations as between Holiday Nova and the Customer and supersedes all previous arrangements, correspondence, tenders, representations, proposals, understandings and communications whether written or oral between the parties.

Amendment

  1. This Agreement shall not be amended, modified, varied or supplemented except in writing signed by Holiday Nova and the Customer.

Waiver

  1. The non-exercise of, or delay in exercising, any power or right of Holiday Nova does not operate as a waiver of that power or right, nor does any single exercise of a power or right by Holiday Nova preclude any other exercise of it or the exercise of any other power or right. A power or right may only be waived in writing by Holiday Nova. A waiver of any breach or non-compliance shall not be and shall not be deemed to be a waiver of any other or subsequent breach or non-compliance.

Severability

  1. Any provision in this Agreement which is invalid or unenforceable in any jurisdiction is to be read down for the purposes of that jurisdiction if possible, so as to be valid and enforceable, and is otherwise capable of being severed to the extent of that invalidity or unenforceability, without effecting the remaining provisions of this Agreement or the validity or unenforceability of that provision in any other jurisdiction.

Notices

  1. All notices required or permitted to be given by one party to the other under this agreement must be in writing, addressed to the other party and:

    1. Delivered to that party's address; or

    2. Sent by pre-paid mail to that party's address; or

    3. Transmitted electronically (including via facsimile) to that party's address.

  2. Any notice given to a party in accordance with this Agreement is treated as having been duly given and received:

    1. When delivered; or

    2. On the third business day after posting; or

    3. On the day of transmission if a business day, otherwise on the next following business day or if sent electronically otherwise then by facsimile, upon receipt by the sender of acknowledgement of receipt from the recipient.

Governing Law

  1. This Agreement shall be deemed being made in Victoria, Australia, and shall be subject to the law of that State. The parties shall be subject to the non-exclusive jurisdiction of the courts of that State and any courts that may hear appeals from those courts in relation to any proceedings concerning this Agreement.

Interpretation

  1. In this Agreement unless the context otherwise requires:

    1. The singular shall include the plural and vice versa;

    2. Words importing persons shall include corporations and words importing the masculine gender shall include the feminine gender;

    3. The headings shall not affect the interpretation or construction of this Agreement;

    4. Reference to any statute shall mean that statute as amended, modified or replaced from time to time and includes orders, ordinances, regulations and rules and by-laws made in terms of or pursuant to the relevant legislation;

    5. Reference to a party or parties includes a reference to its successors and permitted assigns in accordance with this Agreement; and

    6. "Including" means "including (without limitation)".

  2. This agreement must not be construed adversely against a party just because that party prepared it.

How do I write a review with photos and videos?

Once your stay or activity is over you will receive an email asking for a review. If you don't review you will receive another reminder email in a month giving you time to download your photos and upload your videos to youtube.com You have 3 months to review before your chance to express your opinion ends. Reviews are helpful to agents, future customers and yourself. You can pass the link to your review to friends and family.

How do we use eco quota's to protect the environment?

Agents that run activities or tours on Holiday Nova® can set a quota. These quotas will be checked by Holiday Nova® and the local government and laws to assure they are closely regulated. Quotas can be set for certain periods (seasons). Used and available quota will be displayed on the page after you press search on the home page. An example might be a quota for fishing on a river in Peru or farming picking blums for Rakija in the mountains of Velebit.
